Local Planning

Local Governments are responsible for planning by ensuring appropriate planning controls exist for land use and development, which is done by the creation and preparation of Local Planning Schemes and Strategies. Local Planning schemes set out the way land is to be used and developed, classify areas for land use and include provisions to coordinate infrastructure and development with the Local Government area.

There are two different approvals that must be received from the Shire before any construction can start. These approvals are broadly separated into two systems: the development approval process and the building approval process. Approval in one system does not mean approval in the other. Development approval must be received before proceeding to the building approval process, unless an exemption applies.

Development Approvals 

A Development Application (DA) is a formal request to your local council or planning authority for permission to carry out a new project, such as building a home, altering an existing property, or changing a site's land use. It ensures the proposal complies with local zoning and environmental standards before work begins.

The assessment criteria include:

  • compliance with the relevant provisions of the Local Planning Scheme;
  • suitability of the proposed use in relation to the property’s zoning classification;
  • whether the proposal avoids detrimental impacts on the surrounding locality and nearby public land; and
  • whether the proposal avoids adverse impacts on neighbouring landowners and occupants.

In addition to the requirements of the Scheme, proposed developments must also comply with applicable State Planning Policies (SPPs) prepared by the Western Australian Planning Commission. These policies address a broad range of planning matters, including the R-Codes. More information can be found at Planning codes and state planning policies

Zoning

Zoning is a planning mechanism used by local governments to classify land into designated areas, or zones, which determine the types of land uses, development, and buildings permitted within each area.

Local Zoning within the Shire of Cuballing include:

  • Rural – land use designations applied to non-urban areas primarily reserved for agriculture, forestry, conservation, and resource management.
  • Rural Residential - designates semi-rural land primarily for low-density residential living rather than commercial agriculture. Also provided to lots that range from 1 ha to 4 ha.
  • Rural Townsite – designates land on the outskirts or peripheries of small country towns to accommodate typical small-town uses while preserving a rural setting
  • Special Use - Areas designated for specific uses like hospitals, universities, or facilities where important things happen that don't fit neatly elsewhere.

How do I apply for Development Approval in the Shire of Cuballing? 

To apply for development approval, it’s important to consult with either the Cuballing CEO or the Shire planning officer to check whether you need approval for your desired works. In the instance that developmental approval is required, you will need to:

  • Completed the DA Application form
  • Pay the prescribed Planning Fees
  • Supply any plans or other details of the proposed works – site, floor and elevation plans

After the application is assessed by the town planning officer or CEO, the application will need to go to the next Monthly Council meeting. At the ordinary meeting of council, councillours will either approve, approve with conditions or reject your development application.

Once approval has been received, you are then able to proceed with applying for a Building approval to start works. More information can be found going to the Building Page.

What if I dont agree with the decision made by Council? 

If you disagree with a decision made by Council regarding your development application, or with any condition imposed by Council, you may contact the Shire by email, phone, or in person to discuss your concerns and explore a possible resolution.

If, following these discussions, you remain dissatisfied with the outcome, you may lodge an application for review with the State Administrative Tribunal within 28 days of the Council’s decision at the Ordinary Council Meeting (OCM). How long does a development approval last for? 

Generally, planning approval is valid for 2 years.

What happens if I dont have a development approval and commence construction/development? 

Should construction or a development take place with no planning approval, the owners may need to apply for a retrospective planning or building permit. Please contact the Shire Building Surveyor or planning officer for further details or visit Building Services
